New Jersey State Assembly passed the Medical Aid in Dying for the Terminally Ill Act with a 41-33 vote, followed by approval in the Senate with a 21-16 vote.

Governor Phil Murphy has stated he will sign the bill, making New Jersey the eighth state with legal physician-assisted suicide(PAS). Governor Murphy stated, “Allowing terminally ill and dying residents the dignity to make end-of-life decisions according to their own consciences is the right thing to do. I look forward to signing this legislation into law.”

The bill, sponsored by 17 Democratic Assembly members and Senators, passed mostly along party lines with four Republican Senators and no Republican Assembly members voting for passage.

The bill states that it “permits qualified terminally ill patient to self-administer medication to end life in humane and dignified manner.” The structure of the physician-assisted suicide will work similarly to the six other states and DC with legal PAS via legislation (Montana has legal PAS via court ruling and thus no PAS program). Patients are required to be 18 years old or older, have a terminal illness with a life expectancy of six months or less, and be capable of making medical decisions.

Matt Valliere, Executive Director of Patients Rights Action Fund, opposed the measure and stated, “New Jersey ought to be investing in better care and support at the end of life, not enshrining this dangerous public policy into law.”

The law is supposed to go into effect within four months after the Governor signs the bill.

On Saturday, Feb. 18, 2017, DC became the seventh jurisdiction in the United States to legalize physician-assisted suicide (PAS), following Colorado (2016), California (2015), Vermont (2013), Montana (2009), Washington (2008), and Oregon (1994).

Death with Dignity Act of 2015 (later renamed to reflect the 2016 passage), was introduced by DC Councilmember Mary Cheh (D) on Jan. 14, 2015 and signed by Mayor Muriel Bowser (D) on Dec. 19, 2016. The law is based on Oregon’s law, as are most PAS laws in the United States. It legalizes a process that authorizes physicians to prescribe life-ending medication to terminally-ill adult residents of DC who want the option to end their lives. Before residents can obtain the lethal medication, they must meet residency and other requirements, be examined by two different doctors, and make two oral requests and one written requests for the aid-in-dying medication.

Debate over Physician-Assisted Suicide Drug Cost Flares Up

The debate over physician-assisted suicide drug costs has flared up as news about increases comes to light. Seconal (generic name secobarbital), the drug most commonly used for physician-assisted suicide, was originally developed by Eli Lilly and Company in 1934 as a sleeping aid, anesthetic, and anticonvulsant (stopping seizures). The drug cost less than $200 in 2009 for a lethal dose of 100 capsules. The price rose to $1,500 over the subsequent six years. After Valeant Pharmaceuticals International bought Seconal in February 2015, the price doubled to $3,000 for a lethal dose, a rise of 1400% in seven years.

Critics have pointed out that the raise in price corresponds with California legalizing physician-assisted suicide on Oct. 5, 2015, the fifth state to do so after Oregon, Montana, Vermont, and Washington.
